Acceptable Use Policy for DBC:
You will be held responsible for all actions performed by your account whether done by you or by others! If server security / shared hosting space is compromised, the account holder is responsible for all violations of the DBC Terms of Service (the “Terms of Service”) and this Acceptable Use Policy (this “AUP”), including SPAM, and all disconnect and reconnect fees associated with violations.
The following terms constitute an agreement between you and DBC. This AUP governs your use of the services provided by DBC (the “Services”).
BY USING THE SERVICES YOU SIGNIFY THAT YOU AGREE TO THIS AUP.
Type of Service:
This service agreement provides a shared email server using Insert Mail Server Type Description, and includes Web Mail (email accounts are accessible through a web browser) as well as POP, SMTP, or IMAP protocols for sending and receiving email from a desktop email client. Customer will share server space with other domains and not have an exclusive right or reservation of the resources and or disk space that the server may have available to it.
This service agreement provides a shared hosting environment, the web host stores and manages data from more than one website and a shared email server using Insert Mail Server Type Description, and includes Web Mail (email accounts are accessible through a web browser) as well as POP, SMTP, or IMAP protocols for sending and receiving email from a desktop email client. Customer will share server space with other domains and not have an exclusive right or reservation of the resources and or disk space that the server may have available to it.
This service agreement also provides a cloud / dedicated server hosting environment and a shared email server using Insert Mail Server Type Description, and includes Web Mail (email accounts are accessible through a web browser).
General rules for our customers:
You agree to back-up all of your Customer Content, including email content, so that you can access and use it when needed. You are solely responsible for backing up your data in all circumstances. DBC does not warrant that it backs-up any Account or Customer Content and you accept the risk of loss of any and all of your Customer Content.
You shall not re-sell or otherwise exploit for commercial purposes any of the Services (or portion thereof), including any of DBC related technologies.
You shall not collect (or permit anyone else to collect) any Customer Content or any non-public or personally identifiable information about another Customer or any other person or entity without their prior written consent.
You are prohibited from using this Site or the Services in a manner (as determined by in its sole and absolute discretion) that: is illegal, promotes or encourages illegal content, activity, products or services (regardless of their form); promotes, encourages or engages in child pornography or the exploitation of children; promotes, encourages or engages in terrorism, war, violence or hatred against people, property or animals, or self-harm; promotes, encourages, or engages in fraud and deception, including fake accounts, identity or account theft, data theft, or pyramid schemes; engages in online harassment, bullying, stalking, or other forms of abusive or intimidating behavior targeting any person or entity; promotes, encourages or engages in any computer or network hacking or cracking; promotes, encourages or engages in the (i) sale or distribution of prescription medication without a valid prescription and (or) license; (ii) illegal wildlife trade; infringes on the intellectual property rights or other proprietary rights of another Customer or any other person or entity, or links to content hosted on third-party sites or servers that infringe such rights; violates the privacy or publicity rights of another Customer or any other person or entity, or breaches any duty of confidentiality that you owe to another Customer or any other person or entity; engages in or instigates actions that cause harm to DBC or any other person. Such actions include, but are not limited to, actions resulting in blacklisting any of DBC IPs by any online spam database or actions resulting in DDOS attacks to any servers; contains or installs any viruses, worms, bugs, Trojan horses, Cryptocurrency Miners or other code, files or programs designed to, or capable of, using many resources, disrupting, damaging or limiting the functionality of any software or hardware; interferes with the operation of this Site or the Services found at this Site; contains false or deceptive language, misinformation, disinformation or unsubstantiated or comparative claims (including regarding DBC or Services).
Limitations of Service:
DBC is not responsible for training Customer or Customer's employees on the use of their respective email clients. DBC is not responsible for troubleshooting email problems not directly related to the Shared Email Hosting Services and the DBC's equipment, facilities, or servers. DBC is not responsible for maintaining and renewing Customer's domain name MX records or other DNS-related functions if Customer's domain name is not hosted by the DBC.
DBC is not responsible for Customer's domain being listed on any third-party blacklist or suppression list not under DBC's direct control. DBC is not responsible for troubleshooting or correcting any problem with Customer being able to send or receive email to or from a third party due to blacklists, suppression lists, third party software or firewalls, network security settings or any other factor not directly under DBC's control. DBC is not responsible for Customer's domain shared host pack / cloud server / dedicated server backup - Separate domain / host Back up will not be provided. It will be of extra cost. Only Weekly overwrite back up will be provided. Customers are advised to take back up of your shared host pack / cloud server / dedicated server on regular intervals to preserve website data / files / email ids data / etc., All Options available in the host / server access control panel / Cpanel access.
Antivirus, Trojan, and Malicious Code Disclaimer:
DBC email servers make use of enterprise class antivirus software in order to protect the server and detect virus-infected email messages. Infected email messages will be handled per DBC policy and preferences prior to the customer receiving the messages. Additional antivirus options are available and the Customer may configure these options for inbound and outbound email antivirus scanning in their Shared Email Hosting Services control panel. Due to the nature of virus, trojan, and other malicious code dangers, DBC makes no warranty that these features will detect, delete, or otherwise protect Customer from these dangers.
Customer is responsible for implementing their own internal policies and procedures for opening potentially dangerous attachments, and is encouraged to install antivirus software on all access points or computers using DBC Shared Email Hosting Services.
Account Deactivation, Termination, or Cancellation:
Upon account deactivation, termination, or deletion, all stored files, logs, email messages, attachments, address book entries, mailing lists or other data stored on DBC servers will be immediately deleted immediately. DBC has no obligation or responsibility to store Customer's data after Customer's account has been deactivated or terminated.
How Does POP3 Work?:
POP3 (Post Office Protocol – Version 3) is the simplest one. It just downloads the emails in the inbox folder on the email server to your device. This means that POP3 doesn’t retrieve emails located in other folders such as Sent, Drafts, custom folders, and so on.
Also, when we use POP3, by default, the emails downloaded to our device are automatically deleted from the server. So consider that we’ve multiple devices with an email client connected to the same account. In this case, only the first device that connects to the server will download the emails contained in the inbox.
The figure below shows such a situation. First, Emails A and B arrived at the server. Then Client 1 retrieved both emails and then disconnected. So, the server did not keep any emails. Next, Email C came to the server. A moment later, when the server communicated with Client 2, it retrieved only Email C. Thus, we have Client 1 with Emails A and B and Client 2 with only Email C:
How Does IMAP Work?:
IMAP (Internet Message Access Protocol) is the most sophisticated. It’s able to synchronize emails located in any folder on the email server across multiple devices. So all devices connected to the account reflect changes made on one device, such as deleting or moving an email to a custom folder.
The figure below shows this behavior. We’ve all devices with the same emails, regardless of when the emails arrive or when each device connects:
When we use IMAP, copies of the emails and attachments are downloaded on demand so we can view them, but the original emails are kept on the server. In short, we can say that we access the emails directly on the server due to their synchronization.
Statement of Purpose:
The Primary Purpose of DBC is to provide our clients with the resources necessary to put their internet services online reliably in a fast, high availability environment that responds quickly to each client’s individual needs.
Regarding Ultimate Liability:
The client is ultimately responsible for individual server security. DBC disclaims all liability for server / shared hosting space content.
Network Misuse:
All clients are allowed access to the public and private network; however misuse of the network in any way, including interference, will result in a violation of this AUP. All violations of this AUP shall be subject to review by DBC, and an appropriate course of action shall be taken as determined by DBC in its sole discretion including suspension or termination of service. We reserve the right to install and use any appropriate devices including devices designed to filter or terminate access to the IP. Proper use of public network must comply with all local, state, and federal laws. Clients assume full liability for all content which they place on the server. Content displaying or transferring acts of copulation or exposed genitalia is prohibited, regardless of context. In instances involving child pornography, DBC complies with all applicable cyber and state laws. Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting is deemed a violation of this AUP.
Sabotage:
Any type of sabotage, regardless of intention, shall be grounds for termination of an account. This includes but is not limited to abuse of the remote reboot system by using it multiple times in a very short amount of time for improper reasons.
Network Security:
Clients are required and obligated to maintain all security on their shared hosting space / servers. Any and all additional charges that are incurred due to client lack of monitoring or security are the responsibility of the client.
Monitoring Policy:
DBC does not actively monitor the content on its servers / shared hosting space. Dedicated / Cloud server content will only be reviewed upon complaint. Content that does not violate local, state and cyber law or this AUP or the Terms of Service is deemed in compliance and shall remain intact. If content is deemed to be in violation of this AUP or the Terms of Service, it shall be reviewed by DBC, and a course of action shall be taken to correct the problem, which may result in termination of the account or service.
Blacklist Policy:
If any client or any third-party user that is a customer of our client uses DBC services, network, or its physical infrastructure in a manner that causes DBC, or any IP addresses issued by DBC to be “blacklisted” or “blocked”, DBC reserves the right to suspend or terminate services of such client and/or suspend or terminate the access to services, network, and/or its physical infrastructure. Operating DBC service on behalf of, or in connection with or reselling any service to persons or firms listed in the Spamhaus Register of Known Spam Operations database at www.spamhaus.org shall constitute a violation of this AUP.
If a violation of any of the above policies occurs, DBC reserves the right to suspend service immediately and without notice at its sole discretion.
IP Addresses:
All IP addresses issued by DBC are the sole property of DBC. Clients retain no ownership rights to any IP addresses issued by DBC. Clients may not transfer IPs from DBC.
IRC/Bittorrent/P2P:
IRC Usage shall NOT be allowed DBC services or network. It is also deemed a violation of this AUP if it is determined that IRC is the cause or root of a service interruption to other users. Clients may not operate and maintain IRC servers which connect to global IRC networks such as Undernet, EFnet and DALnet. Use of IRC plug-ins, scripts, add-ons, clones or other software designed to disrupt or deny service to other users is prohibited. If a client’s servers are frequently compromised or attract denial of service or distributed denial of service attacks that disrupt or deny service to other clients or users, then DBC may null-route, filter, suspend, or terminate that client’s service. DBC does NOT allow the use of Peer to Peer, IRC or Bit Torrent. We do not allow the transfer of illegal content ever.
DDOS:
Distributed Denial of Service(“DDOS”) is grounds for immediate termination. If involved in initiating or the target of a DDOS attack we reserve the right to terminate your server without notice.
Violation Claims:
Any Claim of Violation of this AUP that is being submitted by a third party must include the name and contact information of the complaining party, the IP address from which the alleged complaint originated, and a description of the violation. This AUP applies to all users of servers provided by DBC, including without limitation the customers, clients and other users of our clients. DBC reserves the right, at its sole discretion, to refuse new service to any individual, group, or business. DBC also retains the right to discontinue service for any client for any reason or no reason and at any time, including without limitation for violation of this AUP.
